Comments on the CNIL’s consultation draft may be submitted until November 19, 2021; the comprehensive guidance addresses the obligations for recruiting entities (employers, recruiting agents, temp agencies) to have a legal grounds and legal basis for processing, conduct a DPIA for high risk processing, provide information to job candidates, handle access requests promptly, and strictly limit retention of candidate data. Organisations are encouraged to adopt the Ethical Principles for AI and apply them to all stages of AI systems development and application; data preparation and use (in training, testing and operation) should be in compliance with the Personal Data (Privacy) Ordinance, minimising the amounts of personal data, managing data quality and accuracy, and documenting all data processing. Surveillance: Korea PIPC Advises on CCTV Use
CCTV surveillance is considered personal information under the Personal Information Protection Act where the data subject is identifiable, and includes CCTV streaming in addition to recordings; CCTV may be installed and used for multiple purposes (such as workplace training, audits, company vehicles) as long as controllers comply with PIPA obligations to have a legal basis (consent or a legitimate interest), sufficient security safeguards, proper notice posted on premises, and a minimized retention period. Best Practices: Gibraltar DPA on Data Sharing
The updated Data Sharing Code of Practice reflects recent changes including Gibraltar’s amendments to its Data Protection Act and post-Brexit incorporation of GDPR; data sharing must have both a legitimate basis and satisfy the lawfulness principle, include appropriate safeguards, and DPIAs are required for high risk processing but generally recommended to demonstrate compliance.
