Ads Compliance FAQs

  • What is interest-based advertising and how do I comply?

Interest-based advertising is the practice of collecting data about users’ online activities across websites and using that data to deliver advertisements tailored to their inferred interests and preferences. Under the CCPA, this practice constitutes a “sale or sharing” of personal information and gives California consumers the right to opt out.

Compliance requires organizations to provide clear, prominent notice to consumers about your data collection and targeting practices, along with an easy-to-use opt-out mechanism (or opt-in for sensitive data). Organizations must also honor user choices, limit data use to legitimate advertising purposes, bind third parties to the same standards, and retain data only as long as necessary.

  • What does the AdChoices icon mean?

The AdChoices icon is a small, triangular blue icon displayed in or near digital advertisements to signal that interest-based advertising data is being collected or used on that device. It represents a company’s commitment to consumer transparency and control over their interest-based advertising experience.

When a consumer sees the AdChoices icon, it means the ad is part of a self-regulatory program governed by the Digital Advertising Alliance (DAA), and that the consumer has an avenue to learn more about or opt out of the interest-based advertising practices behind that ad. The icon serves as a recognizable, standardized notice mechanism across websites, mobile apps, and connected TV environments.

  • How does AdChoices work?

AdChoices is a self-regulatory program administered by the Digital Advertising Alliance (DAA) that enables participating companies to provide consumers with transparency and control over interest-based advertising. When a consumer clicks the AdChoices icon, they are directed to a notice and/or a preference management mechanism where they can learn about the data being used for interest-based advertising and exercise their opt-out choices.

The program works across four implementation pillars: (1) always-available settings in mobile apps and on-device CTV menus; (2) ad-level implementations within video player bars or directly in/near the ad; (3) at-time implementations via voice controls, QR codes, or periodic notices; (4) asynchronous implementations such as unboxing instructions for new devices or periodic audio prompts on podcasts and (5) web implementations which can be done in ad or on the publisher website through the privacy notice or web page footer.

  • What are the AdChoices program requirements for publishers?

Publishers participating in the DAA AdChoices framework are required to: (1) include an enhanced notice link (featuring the AdChoices icon and text) on every page or within every app where third-party IBA data collection occurs; (2) provide an easy-to-use opt-out mechanism linked to a preference manager or instructions for device-specific controls; (3) include a statement of adherence to the DAA Principles in their privacy policy; and (4) link users to a disclosure describing IBA practices and listing third-party opt-out mechanisms. Failure to meet these requirements can trigger enforcement by the Digital Advertising Accountability Program (DAAP).

  • How do I implement the AdChoices icon in my ads?

The AdChoices icon can be served by the advertiser directly, through an ad agency, via a DAA-certified Approved Provider, or through a third-party ad server with AdChoices Icon Certification. With TrustArc, you can easily implement the AdChoices icon using the TrustArc javascript tag together with your ad creatives. Your end users can click on the AdChoices icon and either an interstitial overlay will appear or the user will be directed to the Preference Manager window.
