TrustArc Terms of Use for Artificial Intelligence Features

These TrustArc Terms of Use for Artificial Intelligence Features (“TrustArc AI Terms” or the “Terms”) incorporate and will be considered part of TrustArc’s Subscription and Services Agreement and/or any other written agreement by and between the parties governing their use of the TrustArc Services. The Terms govern your use of artificial intelligence, machine learning, or similar technologies (“AI Technologies”) which are developed and managed by third parties service providers (each a “Third-Party Provider”) and have been made available within any AI-enabled features for the TrustArc Services, including those set forth in Table 1 (“AI-Enabled Features”).

Use of the AI-Enabled Features is completely optional, and are, in each case, provided for your convenience and benefit. Due to the novel and evolving nature of AI technology, all AI-Enabled Features are offered “AS-IS” without any warranties or guarantees. When users on your account use the AI-Enabled Features, that use constitutes your instruction for TrustArc to submit the relevant data to the applicable Third-Party Provider.

NymityAI Reasonable Use: Each user on your account shall be subject to a reasonable use limit of approx. thirty (30) NymityAI queries per day. TrustArc reserves the right to reasonably adjust this limit, from time to time.

TrustArc will endeavor to enable privacy and security controls made available to us by the Third-Party Providers, however, TrustArc is not responsible for the quality, accuracy, effectiveness, safety, or security of AI-generated output. You must therefore carefully review all AI-generated output before using it (e.g., by consulting an internal or external subject-matter-expert), and we further recommend that you do not input any sensitive, proprietary, confidential, or personal information (including contact details, account numbers, personal identifiers, or any other information about an individual) into the AI-Enabled Features. Additionally, you are responsible for ensuring that your use of AI-Enabled Features is compliant with all applicable laws, including data protection laws, and that, as such, you maintain a lawful basis for processing.

TrustArc’s Services and the AI-Enabled Features are not intended to receive or process meaningful works of authorship. Therefore, you agree not to involve TrustArc or any Third-Party Provider in a claim that a copyright you hold has been infringed through a Third-Party Provider’s use of information that you have input into the AI-Enabled Features.
